These terms and conditions administer the use of Torus websites, mobile apps, and services. Use of Torus websites, mobile apps, or services denotes that you accept all terms and conditions in full. Any unauthorized use of the content of Torus websites, mobile apps, or services may violate copyright, privacy, trademark, and publicity laws and communications regulations and statutes. By using Torus websites, mobile apps, or services, you agree to use for legal, legitimate purposes and you agree to not use our websites, mobile apps, or services to conduct any activity that would constitute a civil or criminal offense or violate any law. We reserve the right to refuse service to anyone, at any time, for any reason.‍

All material within Torus websites, mobile apps, or other services, visual or written, unless otherwise stated, is owned by Torus, Inc. and/or its licensors and is assumed copyrighted. All material herein applies under the intellectual property rights and are reserved. Material may be viewed, downloaded, and used for personal use only, per the terms and conditions of this company. Material from Torus websites, mobile apps, or other services is not for republication and may not be sold or rented, reproduced, replicated, or otherwise copied for enterprise gain.

Your privacy is important to us, and we are committed to protecting your personal information. Any personal information submitted in connection with your use of the Torus website, Torus mobile app, Torus services, or Torus Station is subject to our privacy notice found at https://www.torus.co/privacy-notice, which is hereby incorporated by this reference. We will use information about you that we obtain either directly from you or that we obtain by nature of your use of Torus websites, mobile apps, services, or products in accordance with our Privacy Notice solely in providing services to you and improving the Torus experience.

Torus, Inc. does not source any personal information to third parties, nor do we store information about your website visit or mobile app use other than to analyze content performance through the use of cookies, which you can turn off at any time by modifying your Internet or mobile device’s browser settings. We are not responsible for the republishing of any content found on Torus websites on other websites or media without permission. Torus reserves the right to delete any comments or submissions related to Torus websites or Torus mobile apps that may be deemed spam or questionable spam, profanity, language or concepts that may be deemed offensive.

Our websites and mobile apps may contain typographical errors or inaccuracies. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time, without prior notice (including after an order has been submitted). Such inaccuracies or errors or omissions may relate to product description, pricing, promotion and availability and we reserve the right to cancel or refuse any order placed based on incorrect pricing or availability information, to the extent permitted by applicable law. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities. All efforts have been made to ensure the color and design of our products are displayed as accurately as possible on our websites and our mobile apps.

All purchases through Torus websites or Torus mobile apps are subject to product availability. In our sole discretion, we may limit or cancel the quantities offered or limit the sales of our products or services to any person, household, geographic region or jurisdiction.

All content provided on Torus websites or Torus mobile apps is for informational purposes only. Torus, Inc. makes no guarantees of the accuracy of any information on our sites or mobile apps or found by following a link to our sites or mobile apps. Torus is not liable for any errors or omissions or availability of its information. Changes may be made to pages within Torus websites or mobile apps without notice. By using Torus websites or Torus mobile apps, you assume all risks associated with viewing and browsing the site or app.

Torus websites and Torus mobile apps may not be used in any manner which damages the site or app or the accessibility of the site or app, or which is in any way unlawful, fraudulent or illegal. Any use of spyware, Trojan horse, worm or virus of that nature is forbidden. Any automated data harvesting or unsolicited commercial transmissions in relation to Torus sites or mobile apps are banned. You agree not to attempt to interfere with our websites or apps network or security features or to gain unauthorized access to our systems. Any activity of this nature and of any information within will be prosecuted to the fullest extent of the law.

Torus websites, mobile apps and services are provided to the public “as is” without warranty or representations, express or implied. Torus websites and mobile apps do not guarantee to be readily available or that the material within is anything but the Torus opinions and originality. Torus also holds no responsibility and will not be liable for any viruses that may infect or damage your computer by viewing or downloading video or audio received from Torus sites or mobile apps. Any information transmitted to sites or apps by a viewer including requests or comments will be nonconfidential and uncompensated.

Torus is not liable to anyone, for the contents, use or other connections within its websites or mobile apps. Torus websites and mobile apps are provided free of charge and we do not accept responsibility for any personal or commercial loss. Any loss of profits, contracts or business agreements is not the liability of Torus. Any actions contrary to the websites or mobile apps resulting in any loss, damages, expenses and liabilities, including and without limitation to legal expenses and any costs incurred to Torus or a third party in settlement of a claim due to a breach of these terms and conditions shall be indemnified to Torus. You further accept that Torus limits the personal liability of its employees and executives. Use of Torus websites, mobile apps, or services demonstrates that you agree to never enter a personal claim against a Torus employee or executive in regard to any loss you may incur in connection with Torus websites , mobile apps, or services.

Usage of Torus websites, mobile apps, and services promotes that you agree that the limitations of liabilities set forth in these terms and conditions will protect Torus executives, board members, employees, subsidiaries, successors, assigns, and sub-contractors as well as Torus, Inc.

Per these terms and conditions, Torus is not responsible for fraudulent misrepresentation, personal injury or death caused by Torus negligence. By using Torus websites, mobile apps, and services, you concur that the liability set forth in these terms and conditions are reasonable.

Mobile Messaging Terms & Conditions

Torus SMS messages are messages that may include important system alerts, installation and service appointment details, product features, upgrades or enhancements, special offers, and events from Torus. By subscribing, you agree to receive autodialed marketing messages to the telephone number used at the time of opt-in. Consent is not required as a condition of purchasing any goods or services.

Message frequency may vary. Message and data rates may apply. Depending on your text plan, you may be charged by your carrier.

Mobile carriers are not liable for delayed or undelivered messages. Terms & Conditions are subject to change.

Arcadia Connect Terms & Conditions

Terms of Service

These terms apply when you use Torus’s utility data connection feature (“Connect”) to share your utility account information with us.

1. What Connect does.  Connect is provided through Arcadia Power, Inc. (“Arcadia”), an independent third-party service that Torus uses to retrieve utility billing and interval usage data on our behalf. By entering your utility account credentials through Connect, you authorize Arcadia to access your utility account and retrieve your data, and authorize Torus to receive and use that data as described in our Privacy Policy.
2. Your authorization.  You represent that you are the authorized holder of the utility account you are connecting, or that you have the account holder’s permission to do so.
3. No utility affiliation.  Arcadia and Torus are independent of, and not affiliated with, your utility. Your utility has not reviewed or endorsed this service.
4. Purpose and duration.  Torus uses this connection to evaluate a potential business relationship with you. This authorization applies to that evaluation period. If you enter into a service agreement with Torus, ongoing data collection continues under the terms of that agreement.
5. No warranty.  Connect is provided “as is.” Torus does not guarantee Arcadia will successfully retrieve data from your utility, or that retrieved data will be complete or error-free.

Privacy Policy

This policy describes how Torus, Inc. handles information collected through Connect.

What we collect - Arcadia retrieves your utility billing history and interval usage data on our behalf, including up to 12 months of historical data where available. Your login credentials go directly to Arcadia; Torus does not receive or store them.

Why we collect it - We use this data to evaluate your electricity usage and determine whether Torus’s services fit your facility.

How long we keep it - If you do not enter into an agreement with Torus, we will direct Arcadia to stop collecting your data and delete what we’ve collected within [30] days of that determination. If you become a Torus customer, data collection continues under your service agreement with Torus.

Who else has access - Arcadia processes and stores this data on our behalf, using its own security measures, and subject to its own privacy policy at arcadia.com. Torus does not sell your data or use it for any purpose other than evaluating or managing your relationship with Torus. Arcadia may separately use anonymized, aggregated data for its own research and reporting, as described in its privacy policy; Torus does not control that use.

Your choices - You can revoke Connect’s access at any time by contacting us at privacy@torus.co or by changing your utility account password.
